To reduce risks and time lost, it is important to understand the grounds for towing, the procedure to follow when a missing vehicle is discovered, and the return policy. A competent response can help avoid unnecessary expenses and, in some cases, allow the vehicle to be rectified on the spot and prevent unloading.

When is towing legal?

Grounds for seizing and moving a vehicle arise when the violation impedes traffic, creates a safety hazard, or is directly prohibited by law. In practice, the most common situations involve stopping and parking in prohibited areas.

Typical Causes

  • Parking under prohibited signs or in areas with a tow truck service sign.
  • Stopping on a pedestrian crossing or closer than the designated distance, as well as on the sidewalk.
  • Parking in disabled spaces without legal grounds.
  • Stopping on tram tracks or in the second lane if this impedes traffic.
  • Driving without the necessary documents in cases where the vehicle is subject to impoundment.
  • A technical malfunction that prohibits operation, or the consequences of an accident that prevent further movement.

What must be documented

During a tow, documents are drawn up regarding the impoundment of the vehicle. It is recommended to verify the correct information: location, time, reason, vehicle details, official, as well as notes on the vehicle's condition and visible damage. If present, document the situation and the vehicle's condition with photos or videos.

When a car can be impounded: specific grounds and exceptions

Towing to an impound lot is used when the violation poses a safety threat, impedes traffic, or directly falls under the circumstances where the law provides for vehicle impoundment. It's important to distinguish: not every "illegal parking" automatically means towing - in some situations, a fine or a requirement to correct the violation is sufficient.

Reasons for which a vehicle may be towed

    • on the sidewalk (unless permitted by signs/markings);
    • at a public transport stop and in its area of ​​operation;
    • on tram tracks or in a way that interferes with trams;
    • in tunnel;
    • in a place where a vehicle blocks access (exit from a yard, traffic lane, entry of special equipment, etc.);
    • in disabled parking spaces without legal grounds.
  • Driving without documents in cases where the driver does not have a driving license or has been deprived of the right to drive.
  • Signs of intoxication in the driver, as well as refusal to undergo a medical examination (subject to compliance with the established procedure).
  • Malfunctions that prohibit operation and require removal from driving, if it is impossible to correct on the spot (for example, certain critical malfunctions of the braking system/steering).
  • Violation of transportation rules (including oversized/dangerous goods) in situations where detention is provided and continued movement is prohibited.

Important: towing is possible when a decision on detention has been issued and the procedures have been followed (recording the violation, drawing up documents, Notification, if necessary, witnesses/video recording, etc.). If the procedure is violated, the actions can be appealed.

Exceptions and situations when towing can be avoided:

  1. You managed to eliminate the reason for the detention before the tow truck started moving: you reparked the car, removed the obstruction, handed over control to a person with a license, etc.

Bottom line: a car is towed to a penalty lot not "at will," but rather when there is a specific reason and the procedure is followed. The most practical protection is to check signs/markings in advance, not to leave your car where it obstructs traffic, and remember: if you arrive in time and can eliminate the cause detained before the tow truck leaves, the vehicle must be returned on site.
